Purchase Terms

These Purchase Terms ("Purchase Terms") govern the purchase and use of paid subscriptions to the Fairway application operated by Archway AI Inc. ("Company," "we," "us," or "our"). These Purchase Terms supplement our Terms of Use and Privacy Policy. In the event of a conflict, these Purchase Terms control with respect to billing and subscription matters.

1. Subscription Plans

Fairway offers the following subscription options:

  • Free Trial: All new accounts receive a 30-day free trial with full access to all features. No credit card is required to start a trial.
  • Pro Monthly: $99 per month, billed monthly.
  • Pro Annual: $999 per year, billed annually (equivalent to $83/month).

Both paid plans include full access to all features: Forecast Call Prep, Executive Report, Field Intelligence, Ask Fairway AI, CRM integrations, shareable reports, temporal memory, and unlimited utility runs.

2. Billing and Payment

  • All payments are processed securely through Stripe. We do not store your credit card information on our servers.
  • Subscriptions are billed in advance on a monthly or annual basis, depending on the plan selected.
  • Subscriptions automatically renew at the end of each billing period unless canceled prior to renewal.
  • You are responsible for any applicable taxes associated with your subscription.
  • If payment fails, we will attempt to charge your payment method again. If payment remains unsuccessful, your account may be downgraded or suspended.

3. Free Trial

  • The free trial provides full access to all Service features for 30 days from account creation.
  • No credit card is required during the trial period.
  • At the end of the trial, you must subscribe to a paid plan to continue accessing the Service.
  • If you do not subscribe, your account will be restricted but your data will be preserved.
  • We reserve the right to modify or discontinue the free trial at any time.

4. Cancellation and Refunds

  • You may cancel your subscription at any time through the Stripe billing portal accessible from your Settings page.
  • Upon cancellation, you retain access to the Service through the end of your current paid billing period.
  • Subscription fees are non-refundable, except where required by applicable law.
  • If you believe you were charged in error, contact us at support@tryarchway.ai within 30 days of the charge.
  • After your subscription ends, your account will be restricted but your data will be retained for 90 days, during which you can resubscribe to restore full access.

5. Plan Changes

  • You may switch between monthly and annual billing through the Stripe billing portal.
  • When upgrading from monthly to annual, you will be charged the annual rate and receive credit for any unused portion of your monthly subscription.
  • Plan changes take effect immediately.

6. Service Availability

  • We strive to maintain high availability of the Service but do not guarantee uninterrupted access.
  • The Service is hosted on Vercel and Supabase infrastructure.
  • We may perform maintenance that temporarily affects availability, with advance notice when practical.
  • We are not liable for service interruptions caused by third-party providers, network outages, or force majeure events.

7. Your Data

  • You retain full ownership of all data you provide to the Service, including CRM data, uploads, and generated outputs.
  • Integration credentials are encrypted at rest and decrypted only in memory during sync operations.
  • Upon account termination, your data will be handled in accordance with our Privacy Policy.

8. Acceptable Use

You agree not to use the Service to:

  • Engage in any illegal activity or violate applicable laws
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Circumvent usage limits or security measures
  • Resell, redistribute, or sublicense access to the Service
  • Use the Service in any way that could damage, disable, or impair its operation

9. Limitation of Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THESE PURCHASE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated at least 30 days in advance via email. Price changes will take effect at the start of your next billing period following the notice. If you do not agree with a price change, you may cancel your subscription before the new pricing takes effect.

11. Governing Law

These Purchase Terms are governed by the laws of the State of California, without regard to conflict of law principles. Dispute resolution is governed by the arbitration provisions in our Terms of Use.
